Terms of Service — ChatVibes AI

1. Acceptance of Terms

By installing, accessing, or using the ChatVibes AI Chrome extension ("the Extension"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Extension.

2. Description of Service

ChatVibes AI is a browser extension that:

Reads visible conversation content from supported messaging platforms (WhatsApp Web, LinkedIn Messaging, Telegram Web, X/Twitter DMs, and Google Messages Web) using heuristic DOM analysis
Displays extracted messages in a side panel interface within Chrome
Optionally caches conversation data locally on your device for faster access
Provides AI-powered conversation analysis (summarization, response drafting, free-form queries, and reflective analysis) via ChatVibes AI's server, which processes requests using Google's Gemini API
Manages user accounts, plan tiers, and usage limits via ChatVibes AI's backend infrastructure and Stripe for billing

3. Eligibility

You must be at least 13 years of age to use the Extension. If you are under the age of 18, you represent that you have the consent of a parent or legal guardian to use the Extension.

4. User Responsibilities

4.1 Account and API Access

To use AI features beyond the free tier, you must sign in with a Google account. ChatVibes AI uses Firebase Authentication for identity management. You are responsible for:

Maintaining the security of your Google account
All activity that occurs under your ChatVibes AI account
Complying with the terms of service of any connected third-party service (Google, Stripe)

AI requests are processed through ChatVibes AI's servers using our Gemini API access. A separate user-supplied Gemini API key is not required for the standard build. A local-SDK variant (for testers) allows you to supply your own API key and bypass ChatVibes AI's servers entirely; in that case, you are solely responsible for your Google API usage and charges.

4.2 Appropriate Use

You agree not to use the Extension to:

Violate any applicable local, state, national, or international law or regulation
Infringe on the privacy rights of others — do not use the Extension to surveil, monitor, or extract data from conversations without the knowledge or consent of participants where required by law
Extract, scrape, or bulk-export conversation data for purposes unrelated to the Extension's intended personal-use analysis features
Reverse-engineer, decompile, or modify the Extension's production build for the purpose of circumventing its intended functionality
Transmit harmful, abusive, or illegal content through the AI features
Process highly sensitive personally identifiable information (PII), protected health information (PHI), or financial data through the Extension, as the raw text of your conversations is transmitted to third-party LLM providers for processing

4.3 Messaging Platform Compliance

Your use of the Extension must comply with the terms of service of the underlying messaging platform (e.g., WhatsApp's Terms of Service, LinkedIn's User Agreement, Telegram's Terms of Service, X's Terms of Service). The Extension reads content from the platform's web interface as rendered in your browser. ChatVibes AI is not affiliated with, endorsed by, or partnered with WhatsApp, Meta, LinkedIn, Telegram, X Corp, Google, or any other messaging platform.

5. AI-Generated Content

5.1 No Guarantee of Accuracy

AI features are powered by Google's Gemini large language models. AI-generated outputs — including summaries, drafted replies, answers to queries, and reflective analyses — are machine-generated and may be:

Inaccurate, incomplete, or misleading
Contextually inappropriate or tonally inconsistent
Based on an incomplete view of the conversation (the Extension extracts visible DOM content, which may not include all historical messages)

You are solely responsible for reviewing, editing, and deciding whether to use any AI-generated content. Do not rely on AI outputs for legal, medical, financial, or other consequential decisions.

5.2 Content Ownership

Your conversation data remains yours. The Extension does not claim any ownership over messages extracted from your conversations.
AI-generated outputs are produced by Google's Gemini API. Ownership and usage rights for AI-generated content are governed by your agreement with Google under their API terms.
The Extension itself (source code, design, icons, documentation) is the intellectual property of Pair and Pivot, LLC and is licensed under the terms specified in the project's license file.

6. Heuristic Extraction Disclaimer

The Extension uses heuristic DOM analysis — examining page layout, structural relationships, ARIA attributes, and text patterns — to extract conversation data. This approach is inherently dependent on the structure of the messaging platform's web interface.

You acknowledge that:

Platform UI updates may temporarily or permanently break extraction accuracy without notice
Extracted data may be incomplete, misordered, or incorrectly attributed in edge cases
Timestamps, sender names, media metadata, and message types are inferred from visible DOM elements and may not perfectly match the platform's internal data
The Extension makes best-effort attempts at accuracy but does not guarantee correctness of any extracted content

7. Data and Privacy

Your use of the Extension is also governed by our Privacy Policy, which describes what data is accessed, how it is stored locally, and what is transmitted externally. Key points:

Conversation data and AI history are stored locally on your device
When you use an AI feature, conversation context is sent to ChatVibes AI's servers for processing; it is not currently stored on our servers
Account-level data (Google identity, plan tier, usage counts) is stored on ChatVibes AI's servers
You can delete all stored data at any time through the Extension's interface or by contacting us for server-side account deletion
We do not sell your data. Your conversation content is not used to train AI models, including by our upstream AI provider (Google's Gemini API terms prohibit training on API-submitted data by default).

8. Third-Party Services

The Extension integrates with the following third-party services:

ChatVibes AI is not responsible for the availability, performance, accuracy, or policies of third-party services. Changes to Google's Gemini API (including model deprecations, pricing changes, rate limits, or content policies) may affect the Extension's AI functionality without prior notice from ChatVibes AI.

9. Availability and Support

The Extension is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation.
Platform updates by WhatsApp, LinkedIn, Telegram, X, Google, or other messaging services may break functionality at any time. We will make reasonable efforts to restore compatibility but do not guarantee a timeline for fixes.
Support is provided on a best-effort, voluntary basis. There is no service-level agreement (SLA) or guaranteed response time.

10. Disclaimers

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Specifically, ChatVibes AI makes no warranty that:

The Extension will meet your specific requirements
Extracted conversation data will be accurate, complete, or timely
AI-generated content will be appropriate, correct, or useful
The Extension will be compatible with future versions of Chrome or any messaging platform
The Extension will be free of bugs, errors, or security vulnerabilities

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHATVIBES AI, ITS DEVELOPERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data, messages, or conversation history
Costs incurred through your use of the ChatVibes AI service or, in the local API key variant, the Google Gemini API
Damages arising from inaccurate extraction or AI-generated content
Damages arising from unauthorized access to locally stored data (e.g., if your device is compromised)
Loss of privacy resulting from your use of the Extension in shared or public environments
Any damages arising from platform terms-of-service violations related to your use of the Extension

THE TOTAL LIABILITY OF CHATVIBES AI FOR ANY CLAIM ARISING FROM OR RELATED TO THE EXTENSION SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO CHATVIBES AI IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10 USD IF NO PAYMENTS WERE MADE.

12. Indemnification

You agree to indemnify and hold harmless Pair and Pivot, LLC from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

Your use of the Extension
Your violation of these Terms
Your violation of any third-party rights, including the terms of service of any messaging platform
Your use of the ChatVibes AI service, including AI features and billing
AI-generated content you choose to send, publish, or act upon

13. Termination

You may stop using the Extension at any time by disabling or uninstalling it from Chrome
Upon uninstallation, all locally stored data (IndexedDB caches, local storage settings, API keys) is removed by Chrome
We reserve the right to discontinue the Extension or any of its features at any time without prior notice
These Terms survive termination with respect to any obligations or liabilities incurred prior to termination

14. Modifications to Terms

We may revise these Terms at any time. Changes will be indicated by updating the "Last Updated" date. Material changes may also be communicated through the Extension's interface or release notes. Your continued use of the Extension after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pair and Pivot, LLC regarding your use of the Extension.
